The Flomaton Town Council voted last Wednesday to seek an attorney general's opinion to clarify how the town can legally spend money collected through its municipal court system.
The council passed a resolution noting the funds collected are deposited into a corrections fund. The resolution states the code section that governs the use of those funds contains some ambiguity as to what constitutes permissible expenditures.
The resolution passed by the council asks the attorney general's office to focus on four questions:
Can the town of Flomaton use the municipal corrections funds for the salary of the municipal judge; can the funds be used to pay the salary of municipal prosecutor; can the funds be used for payment of hourly wages and benefits for the police officers attending court; and can the fund be used for payment of the utilities from the municipal complex, which includes the municipal court.
